All products offered on this site are subject to availability. We reserve the right to discontinue any product at any time and to limit the quantity of any product that may be purchased. Product descriptions, images, and specifications are provided for informational purposes and are as accurate as possible, but we do not warrant that descriptions are error-free or complete. Colors and textures may appear differently depending on your device display. If a product is materially different from its description, your remedy is to return it under our Refund Policy.
Pricing and Currency
All prices displayed on this site are in United States Dollars (USD). All transactions are processed in USD. If you are accessing the site from outside the United States, your payment provider may apply a currency conversion and may charge a conversion fee. We are not responsible for any such fees or for differences between the amount charged and the amount that appears on your statement due to exchange rate fluctuations.
We reserve the right to change prices at any time without prior notice. Price changes do not apply retroactively to orders that have already been placed and confirmed. In the event of a pricing error, we reserve the right to cancel an order placed at an incorrect price. If we cancel an order due to a pricing error, we will notify you and issue a full refund.
Order Acceptance
Your order constitutes an offer to purchase. We accept your order when we send an order confirmation and begin processing. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, suspected fraud, errors in pricing or product information, or violation of these terms. If we cancel an order after payment has been processed, we will issue a full refund.
Payment
Payment is due at the time of order placement. We accept payment methods as displayed at checkout. Payment processing is handled by third-party processors. By providing payment information, you represent that you are authorized to use the payment method and that the information provided is accurate. You are responsible for any fees charged by your payment provider in connection with the transaction.
Shipping and Delivery
Shipping terms are described in our Shipping Policy. In summary: orders are processed within one to three business days, delivery is estimated at six to twelve days from dispatch, shipping is free on all orders, and all duties, taxes, and import fees are covered by us. Delivery estimates are not guarantees. Risk of loss passes to you upon delivery to the carrier.
Returns and Refunds
Returns are accepted within sixty days of delivery. Refunds are processed within five to ten days of our receipt of the returned item. The complete terms are set out in our Refund Policy, which is incorporated into these Terms of Purchase by reference.
Limitation of Liability
To the fullest extent permitted by law, our liability arising from or related to any product purchased from this site or any use of this site is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or loss of sleep, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Product Use and Safety
Our products are sleep accessories intended for normal domestic use. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition. If you have a medical condition that affects sleep or requires a specific sleep surface, consult a qualified healthcare professional before using any sleep product. You are responsible for using the product in a safe and appropriate manner. Do not use a product that has been damaged or altered in a way that affects its structural integrity.
Governing Law
These terms are governed by the laws of the United States and the state in which the business is registered, without regard to conflict of law principles. Any dispute arising from these terms or from a purchase shall be resolved in the courts of that jurisdiction, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms of Purchase from time to time. The version in effect at the time you place an order governs that order. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
